QFOS; Questionnaire of Foreign Operators’Safety (외국항공기의 소유자등 안전성 검토를 위한 질의서)
Introduction (작성 개요) 1. Purpose of the QFOS (외국항공기의 소유자등 안전성 검토 질의서의 목적) The Article 33 of the Convention on International Civil Aviation states that the certificates of airworthiness and the certificates of competency and licenses issued or rendered valid by the contracting State in which the aircraft is registered shall be recognized as valid by the other contracting States, provided that the requirements under which such certificates of licenses were issued or rendered valid are equal to or above the minimum standards which may be established from time to time pursuant to the Convention. Though air operator certificates are not formally included yet in the mutual recognition statement, the same policy is currently applied by almost ICAO contacting States. 국제민간항공협약 제33조에서 항공기가 등록된 체약국에 의해 발급받거나 유효하다고 인정받은 감항증명서 및 certificates of competency 및 자격증은 타 체약국에 의해 유효하다고 인정받아야 하며 이러한 증명서 혹은 면허증이 발급 혹은 유효하다고 인정받은 요건은 동일하거나 혹은 협약에 따라 수시로 설립될 수 있는 최소기준 이상을 준수하여야 한다고 명시하고 있다. AOC가 아직까지 상호 인정문에 공식적으로 포함되진 않았지만, 대부분의 ICAO 가입국들에 의해 동일한 규정이 현재 적용되고 있다. Notwithstanding the implementation of the above provisions are deemed to solve the problem of the mutual recognition, the results of ICAO safety oversight audit programme show that several contracting States are experiencing difficulties in performing their safety oversight function according to the Chicago Convention. Consequently, doubts may arise about foreign operators’ capability to comply with international safety standards. 위 조항의 이행이 상호 인정 문제를 해결할 수 있을 것으로 보임에도 불구하고 ICAO의 안전평가 감사 프로그램은 몇몇 체약국들이 시카고 협약에 따라 그들의 안전감독기능을 수행하는데 어려움이 있다는 것을 보여주고 있다. 결과적으로 외국항공기의 소유자등의 국제적인 안전기준 준수 능력에 대한 의심이 생길 수 있다. In order to maintain credibility in international aviation system, the MOLIT has developed the current "Question of Foreign Operators’ Safety" to be completed by foreign operators who intend to perform commercial flights in the Korean airspace. Accurate and prompt response should promote the authorization process; endorsement for accuracy and validity of the provided information by the operator’s State Civil Aviation Authority is required. 이에 따라, 대한민국 공역에서 상업항공운송을 수행하고자 하는 외국항공기의 소유자등의 국제항공 시스템 신뢰성 유지를 위하여 QFOS를 작성하여야 한다. 정확하고 신속한 답변은 허가절차를 위하여 필요하며, 제공된 정보의 정확성과 유효성을 확인하는 외국항공기의 소유자등의 항공당국으로 부터의 확인이 필요하다.

2. List of the required documents (제출서류 목록)
The following documents shall be submitted with the QFOS:
① Copy of the current Air Operator Certificate or equivalent document;
② Copy of the current Operations Specification or equivalent document describing the details
and information concerning the operational capabilities;
a) Operator’s fleet(type, model, registration marks);
b) Area and type of operations;
c) Special approvals(LVO, B-RNAV, RVSM, EDTO, MNPS, Transport of Dangerous Goods, etc.); and
③ Copy of document on equivalent parts available to verify the details of the provided information or material.

다음의 서류를 질의서와 함께 동봉하여 보내야 한다.
① 현재 AOC 혹은 그에 상응하는 문서 사본;
② 운항능력과 관련하여 세부사항과 정보를 보여주는 현재 운영기준 혹은 그에 상응하는 문서 사본:
a) 운항 기종(타입, 모델, 등록번호);
b) 운항 타입 및 지역;
c) 특수 승인(LVO, B-RNAV, RVSM, EDTO, MNPS, 위험물 운송 등);
③ 질의서에 제공된 정보와 자료에 관한 세부사항을 증명할 수 있는 문서 혹은 그에 해당하는 부분의 사본.

3. Instructions for filling in the QFOS (QFOS 작성방법)
① Applicable parts need to be submitted according to type of operation and deadline of submission

② The QFOS has to be signed by a person who is in charge of the Air Operator’s Certificate (e.g. Chief Operating Officer, Accountable Manager or Director of Flight Operations) ensuring that the Information and data provided in this QFOS are true and those copies of any documents attached are original.
Also, the QFOS has to be undersigned by a person in charge of the Civil Aviation Authority of the State of the Operator certifying that information and material provided by the Operator are valid
All the required information shall be provided, without omissions.

② 외국항공기의 소유자등의 AOC관련 담당자는 사전질의서에 제공된 정보와 자료가 사실이며 첨부된 그 어떠한 문서도 정본임을 확인하는 서명을 하여야 한다. 또한, 질의서에 외국항공기의 소유자등의 국가의 항공당국 책임자도 외국항공기의 소유자등이 제공한 정보와 자료가 유효함을 확인하는 서명하여야 한다.
요청한 모든 정보는 포함되어야 하며, 빠짐없이 작성하여야 한다.

4. Submission of QFOS (QFOS 작성 후 제출방법)

The accepted methods to fill in and submit the QFOS are:
a) Hard copy by mail;
b) Hard copy by fax;
c) Electronic format by e-mail(preferred); or
When sent via email, QFOS(with signature) and other documents shall be scanned into a format such as PDF.

외국항공기의 소유자등은 다음의 형태로 QFOS를 제출하여야 한다.
a) 출력물(하드카피)의 우편접수
b) 출력물(하드카피) 팩스전송
c) 전자형태 메일 전송(선호)
전자 형태로 전송할 시, PDF파일과 같은 형식으로 서명서를 포함한 질의서 및 모든 첨부서류를 스캔하여 보내야 한다.

2. In case of any deviations from the ICAO Standards, differences shall be notified to the MOLIT(Korean CAA) by the Operator in accordance with the Convention on International Civil Aviation.
