| | Article 91(Restrictions on Employment) of the Seafarers' Act (4) A shipowner shall not assign work harmful or dangerous to pregnancy or childbirth prescribed by the Enforcement Ordinance of the Ministry of Oceans and Fisheries to a female seafarer. (5) A shipowner shall not assign work onboard to a pregnant female seafarer; provided, however, that this shall not apply to any of the following cases: a. Where a pregnant female seafarer applies for work onboard with regard to a voyage within the extent prescribed by the Enforcement Ordinance of the Ministry of Oceans and Fisheries, and a doctor does not deem such work harmful or dangerous to pregnancy or childbirth; or b. Where a pregnant female seafarer comes to know the fact that she is pregnant while at sea and is engaged in work necessary for the safety of the relevant ship. (6) A shipowner shall not assign dangerous work onboard or hygienically harmful work prescribed by the Enforcement Ordinance of the Ministry of Oceans and Fisheries to a female seafarer in whose cases one year has not passed after childbirth. | | | 「선원의 안전 및 위생에 관한 규칙」제2조(선박소유자의 임무) 선박소유자는 「선원법」(이하 "법"이라 한다) 제82조제5항에 따라 선내작업시에 발생하는 위험의 방지와 선내위생의 유지를 위하여 다음의 사항을 지켜야 한다. 1. 선내작업에 필요한 기계ㆍ기구ㆍ용구 등의 공급 2. 선내위생의 유지에 필요한 의약품ㆍ위생용품ㆍ의료서적 등의 공급 3. 작업 시 안전을 위한 조명장치ㆍ안전표시 기타 보조기구의 설치 4. 거주구역ㆍ기관실ㆍ조리실 등의 환기ㆍ채광ㆍ조명 및 온도의 유지와 소음 및 진동의 방지등 위생상 양호한 상태를 유지하기 위한 시설의 설치 5. 거주구역 및 창고 등에 쥐ㆍ벌레등을 없애기 위한 약품의 공급 6. 산소 및 인체에 유해한 기체 등의 측정에 필요한 기구의 공급. 다만, 냉동시설이 설치되어 있지 아니한 연근해어선은 그러하지 아니하다. 7. 화물창에서의 작업, 높은 곳에서의 작업, 용접작업, 무거운 물건을 취급하는 작업, 전기류 사용 작업, 어로작업등 위험작업시의 위해방지를 위한 필요한 보호기구의 공급 8. 선내안전 및 위생관리에 필요한 교육의 실시 9. 선내작업시의 위해방지 및 위생의 유지를 위한 선내안전위생수칙의 제정 및 보급
Article 2(Duties of Shipowner) of the Rules on Safety and Health for Seafarers A shipowner shall comply with the following matters to prevent danger of work on a ship and maintain hygiene therein under Article 82 (5) of the Seafarers' Act(hereinafter referred to as "the Act"): a. Supply of machinery, apparatus, and tools necessary for work on a ship; b. Supply of medicine, hygiene products, and medical guide books necessary to maintain hygiene on a ship; c. Installation of lighting devices, safety signs, and other auxiliary devices for safety for work; d. Installation facilities necessary to maintain an appropriate level of hygiene such as ventilation, skylights and lighting in accommodation, engine rooms and galleys, etc., maintenance of temperature, and prevention of noise and vibration, etc.; e. Supply of pesticides to get rid of mice or bugs from accommodation and storage rooms, etc.; f. Supply of tools necessary to measure oxygen or gases hazardous to human body, etc.; provided, however, that this shall not apply to coastal fishing vessels which are not equipped with refrigerating facilities; g. Supply of protective apparatus necessary to prevent injury from dangerous work such as work in hold, work aloft, welding, work involving heavy objects, work involving electricity, and fishing operation, etc.; h. Implementation of education necessary for safety on a ship and hygiene management; and i. Establishment and supply of safety and hygiene rules on a ship necessary to prevent injury from work and maintain hygiene therein. |
