<국외시험ㆍ검사기관 준수사항>

1. 국외시험ㆍ검사기관은 「식품ㆍ의약품분야 시험ㆍ검사 등에 관한 법률 시행규칙」 제11조제1호 및 제2호의 기준 및 방법에 따라 시험ㆍ검사하여야 합니다. 다만, 국제적으로 통용되는 공인시험방법에 따라 시험할 수 있으나, 그 결과에 대하여 의문이 있다고 인정되는 경우 같은 시행규칙 제11조제1호 및 제2호의 기준 및 방법에 따라 시험하고 판정하여야 합니다.
2. 국외시험ㆍ검사기관은 다음 각 호와 같은 행위를 하여서는 아니 됩니다.
가. 판정이 모호한 시험ㆍ검사결과에 대하여 확인 시험ㆍ검사를 실시하지 않는 행위
나. 유효기간이 경과된 표준품, 시약 또는 배지 등을 사용하는 행위. 다만, 유효성을 입증한 경우에는 제외합니다.
다. 의뢰된 시험ㆍ검사 항목이나 해당 시료에 대한 기준ㆍ규격을 시험ㆍ검사할 때 그 시험ㆍ검사 항목을 빠뜨리거나 다른 항목의 기준ㆍ규격을 적용하는 행위
3. 국외시험ㆍ검사기관은 시험ㆍ검사성적서, 시험ㆍ검사일지 등의 문서(전자문서를 포함합니다)를 3년간 보관하여야 합니다.
4. 국외시험ㆍ검사기관은 매년 다음 각 목의 자료를 식품의약품안전처장에게 제출하여야 합니다.
가. 시험ㆍ검사성적서를 발행한 전년도 실적
나. 해당 시험ㆍ검사기관의 정부가 시험ㆍ검사능력을 평가한 자료 또는 국내외 숙련도 평가에 참여하여 시험ㆍ검사능력을 평가받은 자료

Compliance Guidelines for Foreign Testing Laboratories
1. Foreign Testing Laboratories shall conduct laboratory testing in compliance with Article 11(1)1 and Article 11(1)2. Testing may also be conducted in accordance with internationally accepted test methods and in case of any dispute arising relating to test results, and a final decision shall be made based on laboratory testing carried out in accordance with Article 11(1)1 and Article 11(1)2. 2. Foreign Testing Laboratories shall not engage in any of the following activities: a) Skipping of a confirmatory test when the initial laboratory testing indicates a further confirmatory test is required b) Use of reference materials, reagents, or medium beyond the expiration date c) Omission of test items or application of wrong standards or specifications 3. Foreign Testing Laboratories shall keep test reports, testing records, etc. for not less than three years in accordance with the standards set forth by the pertinent laboratory. These documents may also be stored as electronic format. 4. Foreign Testing Laboratories shall submit the following documentations to the Minister of Ministry of Food and Drug Safety at the end of every year. a) List of test reports which have been sent to Korean Government b) A copy of documents demonstrating evaluation of laboratory performance by the pertinent government or evaluation of laboratory performance obtained through participation in international proficiency testing programs.
