난민인정신청서 APPLICATION FOR RECOGNITION OF REFUGEE STATUS

작성방법 및 유의사항 Instructions and Note 1. 난민인정신청서 작성방법 Instructions ‣ 신청서의 모든 질문에 거짓 없이 답해야 하며, 해당이 없는 경우 ‘해당 없음’으로 쓰시기 바랍니다. You must only answer the truth, and you may answer “non applicable“ if that is the case. ‣ 신청서는 한국어나 영어로 작성해야 하며, 모국어로 작성한 경우에는 한국어나 영어로 번역하여 신청서와 함께 제출해야 합니다. You must answer in Korean or English. If you have written the statements in your mother language, then you must submit the translated version along with the application. ‣ 19세 미만인 자녀와 함께 난민인정 신청을 한 경우 If you are applying with a child under the age of 19 (minors) - 자녀가 9세 이하인 경우: 부모가 자녀를 대신하여 신청서를 작성할 수 있습니다. 이 경우 부모는 신청서의 ‘1. 실제 인적사항’란만 작성하고 자녀를 대신하여 서명해야 합니다. If the child is under the age of 9: The parent may fill out the application on the child’s behalf. In this case, the parent shall fill out “1. Personal Information“ part only, and sign the application on the child’s behalf. - 자녀가 10세부터 18세인 경우: 자녀가 신청서의 모든 내용을 작성해야 하며, 부모 또는 자녀 중 한 사람이 서명해야 합니다. If the child is between age 10 to 18: The child shall fill out the entire application, and the parent or child shall sign the application. ‣ 난민인정 심사에 참고할 문서 등 자료가 있으면 접수 공무원에게 제출하시기 바랍니다. If you have supplementary materials, including any documents for reference in the determination of refugee status, then please submit those documents to the officer who receives your application. 2. 난민신청자의 권리 Rights of the Applicant ‣ 한국어로 충분한 의사표현을 할 수 없는 경우에는 귀하가 원하는 언어의 통역을 면접과정에서 제공받을 수 있으며, 귀하가 믿을 수 있는 사람이 면접과정에 동석할 수 있습니다. If you cannot sufficiently express yourself in Korean, you may receive interpretation service of the requested language. In addition, trusted individual may be present in an interview. ‣ 귀하는 변호사의 조력을 받을 권리가 있습니다. You have the right to receive the assistance of an attorney. ‣ 귀하는 본인이 제출한 자료나 난민면접조서의 열람 또는 복사를 신청할 수 있습니다. You have the right to request perusal or copy of your refugee interview protocol or the relevant materials submitted by you. ‣ 귀하는 「난민법」에 따라 생계비, 주거시설, 의료지원 등을 지원받을 수 있습니다. In accordance with the Refugee Act, you may receive support including living expenses, residential facilities, medical services.

3. 난민신청자의 의무 및 유의사항 Obligations and Note for the applicant ‣ 난민신청자는 「난민의 지위에 관한 1951년 협약」 제2조에 따라 대한민국에 체류하는 동안 대한민국의 법규를 준수할 의무 및 공공질서를 유지하기 위한 조치에 따를 의무가 있습니다. You have duties to conform to the laws and regulations of the Republic of Korea as well as to measures taken for the maintenance of public order during your stay in the Republic of Korea under Article 2 of the 1951 Refugee Convention. ‣ 신청서를 접수한 사무소에서 언제라도 연락할 수 있도록 해야 하며, 연락처나 주소가 바뀌면 즉시 접수 사무소에 알려야 합니다. You must maintain contact with the Immigration Office where you have submitted the application, and you must immediately notify the Immigration Office if your phone number or address changes. ‣ 귀하는 난민인정 심사에 성실하게 응해야 하며, 면접 등을 위한 출석요구에도 불구하고 출석하지 않으면 「난민법」 제8조제6항에 따라 난민인정 심사가 종료될 수 있습니다. You must faithfully participate in the refugee status determination procedure. If you fail to appear despite requests for appearance for interviews or other procedures, then the procedure may be terminated in accordance with Article 8(6) of the Refugee Act. ‣ 신청서에 거짓을 기재하거나 거짓 자료를 제출한 경우 또는 중요한 사실을 은폐한 경우에는 난민인정 신청이 불인정될 수 있으며, 난민으로 인정된 후에 그 사실이 밝혀지면 「난민법」 제22조제1항에 따라 난민인정이 취소될 수 있습니다. If you write false statements, submit false documents or conceal important information, your application may be denied. If such fact is found after you have been recognized as a refugee, then your refugee status recognition may be cancelled in accordance with Article 22(1) of the Refugee Act. ‣ 거짓 서류를 제출하거나 거짓 진술 또는 사실을 은폐하여 난민인정을 받거나 인도적 체류허가를 받은 사람은 「난민법」 제47조에 따라 1년 이하의 징역 또는 1천만 원 이하의 벌금에 처하게 됩니다. If you are recognized as a refugee or given permission to stay in Korea on humanitarian grounds based on the submission of false documents, false statements or concealed facts, then you shall be subjected to imprisonment not exceeding one year or fines not exceeding 10 million Korean won in accordance with Article 47 of the Refugee Act. ‣ 난민신청자는 난민인정 신청을 한 날부터 6개월이 지나면 허가를 받아 취업활동을 할 수 있습니다. 그러나 신청일부터 6개월 이내에 취업을 하거나 6개월이 지났더라도 허가를 받지 않고 취업을 한 경우 「출입국관리법」에 따라 처벌을 받을 수 있습니다. You may engage in wage-earning employment if you have received permission to do so after 6 months since you applied for refugee status. However, if you engage in wage-earning employment within 6 months of the date of application submission or without permission even if 6 months have passed, then you may be subjected to punishment in accordance with the Immigration Control Act.
