| 본인은 사실증명 발급 또는 열람 수수료 면제와 관련해 담당 공무원이 ｢전자정부법｣ 제36조제1항에 따른 행정정보의 공동이용을 통해 전자적으로 신청인의 구비서류를 확인하는 것에 동의합니다. * 담당 공무원의 확인에 동의하지 아니하는 경우에는 신청인이 직접 관련 서류를 제출하여야 합니다. Do not complete the shaded sections, and please place a check mark for applicable brackets[ ]. 2. 국내거소신고 사실증명의 발급ㆍ열람은 본인이나 그 법정대리인 또는 그로부터 위임을 받은 사람만 신청할 수 있습니다. Eligible applicants for the issuance of or access to the Certificate of Fact on Overseas Korean Registration shall be limited to the principal, his/her legal representative or authorized person. 3. 다음의 경우에는 「재외동포의 출입국과 법적 지위에 관한 법률 시행규칙」 제11조제2항에 따라 다음의 사람이 국내거소신고 사실증명의 발급ㆍ열람을 신청할 수 있습니다. In accordance with Article 11(2) of the Enforcement Rule of the Act on Immigration and Legal Status of Overseas Koreans, those falling under the following categories may apply for the issuance of or access to the Certificate of Fact on Overseas Korean Registration: 가. 행방불명, 사망 등으로 본인이 의사표시를 할 수 없는 상태에 있거나 명백하게 본인의 이익을 위해 사용될 것으로 인정되는 경우 1) 본인의 배우자, 직계 존ㆍ비속 또는 형제ㆍ자매 2) 본인의 배우자의 직계 존ㆍ비속 또는 형제ㆍ자매[본인의 배우자가 사망한 경우로서 1)에 해당하는 사람이 없는 경우만 해당한다] Where a principal is incapable of expressing intentions due to his/her unknown whereabouts or death, or where it is obvious that the certificate will be used for benefits of the principal: 1) Spouse, immediate relatives or siblings of the principal 2) Immediate relatives or siblings of the principal’s spouse [only when the spouse is deceased and the principal does not have any of those listed in the category 1)] 나. 본인인 외국국적동포와의 채권ㆍ채무 관계에 관한 재판에서 승소판결이 확정된 경우,「주민등록법 시행령」 별표 2 제3호 각 목의 어느 하나에 해당하는 금융회사 등이 연체채권 회수를 위해 필요로 하는 경우 또는 해당 외국인과 채권ㆍ채무 관계에 있는 경우(기한 경과나 기한의 이익 상실 등으로 변제기가 도래한 경우에 한정하며, 채무금액 100만원 이하인 경우는 제외합니다): 본인인 외국국적동포의 국내거소신고 사실증명을 발급받거나 열람하려는 채권자 Where a favorable ruling is confirmed in a trial on a debtor and creditor relationship with an overseas Korean, where the Certification is needed by financial companies that fall under any of the items of the subparagraph 3 of the attached table 2 of the Enforcement Decree of Resident Registration Act for the purpose of collecting overdue debts, or where there is a debtor and creditor relationship with the overseas Korean concerned (only when a debt becomes overdue or an event of default occurs that allows a lender to demand full repayment earlier than an original due date, and the amount of debt is more than 1 million KRW) : - Creditors who intend to receive or access the Certificate of Fact on Overseas Korean Registration of the overseas Korean concerned ※ 채권ㆍ채무 관계를 입증할 수 있는 계약서, 차용증, 어음 등에는 송금 영수증, 공증, 확정일자 등 공적 증거를 담보할 수 있는 서류를 함께 첨부해야 합니다. ※ The contract paper, promissory note and note that prove the debtor and creditor relationship shall be attached by the collateral documents that may guarantee official evidence such as remittance receipt, notarization and fixed date stamp affixed on the agreement, etc. 다. 그 밖에 법무부장관이 공익상 필요하다고 인정하는 사람 Other persons deemed necessary by the Minister of Justice for the public interest. 4. 위임을 받은 경우에는 위임장과 위임한 사람의 신분증(사본)을 첨부하고 신청인의 신분증을 제시해야 합니다. Authorized persons shall present his/her own ID card and the application shall be presented with the Power of Attorney and the ID card (or a copy) of the authorizing person. ※ 다른 사람의 서명 또는 인장의 도용 등으로 허위의 위임장을 작성하여 증명서를 신청 또는 수령한 경우에는 관련 법률에 따라 처벌받을 수 있습니다. ※ You may be subject to punishment under applicable laws, if you apply for or receive the Certificate of Fact by submitting a fraudulent Power of Attorney signed by another individual or falsely done with a stolen seal. 5. 위임은 작성한 날부터 6개월까지만 유효합니다. The Power of Attorney shall remain effective for 6 months from the day of authorization. | |
